4. Quotations and Orders

  • All quotations are non-binding unless otherwise stated.

  • Orders are subject to acceptance and confirmation by the seller.

  • Production will commence only after order confirmation and fulfillment of agreed payment terms.

  • The seller reserves the right to refuse or cancel any order at its sole discretion.

5. Pricing

  • All prices are subject to change without prior notice.

  • Prices may be adjusted due to fluctuations in raw material costs, exchange rates, transportation costs, government regulations, or other market conditions.

  • Any taxes, duties, or charges imposed by the destination country are not included unless explicitly stated.

6. Payment Terms

  • Payment terms shall be agreed upon before production begins.

  • Production and shipment schedules may be affected if payment obligations are not fulfilled on time.

  • Ownership of goods remains with the seller until full payment has been received.

7. Shipping and Delivery

  • Products are shipped by sea freight or land transportation only.

  • Air freight services are not offered unless otherwise agreed in writing.

  • Estimated delivery times are provided for reference only and are not guaranteed.

  • Delivery schedules may be affected by production capacity, shipping availability, customs procedures, weather conditions, or force majeure events.

8. Export and Customs Clearance

  • The seller is responsible for export customs clearance and export documentation in the country of origin.

  • The buyer is responsible for import customs clearance, import duties, taxes, permits, inspections, and compliance with all laws and regulations in the destination country.

  • Any delays or costs arising from import procedures are the responsibility of the buyer.

9. Risk Transfer

Risk of loss or damage transfers according to the agreed Incoterms® and shipping terms specified in the sales contract or commercial invoice.

10. Inspection and Acceptance

The buyer shall inspect the goods upon arrival.

Any claims regarding visible damage, shortages, or defects must be submitted in writing within seven (7) days of receipt of the goods.

Failure to provide notice within this period shall constitute acceptance of the goods.

11. No Return Policy

Due to the custom-made and project-specific nature of container houses and modular structures:

  • All sales are final.

  • Returns, exchanges, or cancellations are not accepted once production has commenced.

  • Orders cannot be returned due to changes in customer requirements, project delays, import restrictions, or local regulations.

12. Warranty

Where applicable, product warranties are limited to manufacturing defects only.

The warranty does not cover:

  • Improper installation

  • Improper use

  • Unauthorized modifications

  • Natural disasters

  • Normal wear and tear

  • Damage caused during transportation after risk transfer

13. Intellectual Property

All website content, including text, images, logos, graphics, designs, product information, and trademarks, remains the property of the seller and may not be copied, reproduced, distributed, or used without prior written consent.

14. Limitation of Liability

To the maximum extent permitted by law, the seller shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Loss of profits

  • Business interruption

  • Delays caused by shipping carriers

  • Customs delays

  • Government actions

  • Force majeure events

The seller's total liability shall not exceed the amount paid for the affected order.

  • Supply chain interruptions

17. Governing Law

These Terms & Conditions shall be governed and interpreted in accordance with the applicable laws of the seller's jurisdiction, without regard to conflict of law principles.
